      • Feb 1978 - Jul 1980

As the FTC's then youngest trial lawyer, I successfully defended the Commissioners and the General Counsel's office in the FTC's first EEO matter. I participated in antitrust and consumer protection investigations, successfully negotiated settlement of an antitrust case that precluded use of restrictive covenants in shopping center leases, Rich’s, Inc., 1976 WL 180712 (F.T.C.), 87 F.T.C. 1372 (1976); solely authored the FTC’s Amicus Curiae Brief that supported the constitutionality of Florida’s Deceptive and Unfair Trade Practices Act, Department of Legal Affairs v. Rogers, 329 So.2d 257 (Fla. 1976); and served as an FTC liaison with National Association of Attorneys General. As an Attorney Advisor in the Office of Director of the Bureau of Competition I reviewed antitrust investigations and cases for over half of the FTC's regional offices (Seattle, San Francisco, Los Angeles, Dallas, Atlanta, and Washington, D.C.); participated in the Merger Screening Committee (which recommended investigating mergers, acquisitions, or joint ventures), and the Evaluation Committee (which recommended investigating, closing investigations, or pursuing actions against anticompetitive conduct or structure); responded to Congressional inquiries; served as liaison with the Bureau of Consumer Protection; served on the Bureau’s Training Committee (and was responsible for all legal education programs). For two and a half years, I successfully tried the FTC’s largest attempted monopolization and predatory pricing case (against ITT and ITT Continental Baking Co.), which had been in pre-trial discovery for 10 years. During the trial, I was lead counsel in multiple phases in selected markets around the nation. Working for the FTC was a hoot! I really earned my chops as an expert in antitrust law. I also gained career-long friendships with some of the finest antitrust lawyers in America.
