Young THAC (“YTHAC”) is a group to empower young practitioners, business professionals, professors, students, and members of the community under the age of 45 with interest in the field of arbitration and Alternative Dispute Resolution (“ADR”). YTHAC provides a unique platform to bring together innovative ideas and thoughtful contributions to the development of arbitration and ADR in Thailand, the region and internationally through subjects which are of interest to young practitioners. The Court's specific functions under the Rules include: (i) fixing the place of arbitration; (ii) assessing whether there is a prima facie ICC Arbitration agreement; (iii) taking certain necessary decisions in complex multi-party or multi-contract arbitrations; (iv) confirming, appointing and replacing arbitrators; (v) deciding on any challenges filed against arbitrators; (vi) monitoring the arbitral process from the filing of the request for arbitration to the notification of the final award to ensure that it proceeds in accordance with the Rules and with the required commitment to diligence and efficiency; (vii) scrutinizing and approving all arbitral awards, in the interests of improving their quality and enforceability; (viii) setting, managing and, if necessary, adjusting costs of the arbitration, including the ICC administrative expenses and the arbitrators’ fees and expenses; and (ix) overseeing emergency arbitrator proceedings.
