State of Uttarakhand which dealt with Sections 302, 364, 201and 120B of IPC; Section 3 (2)(5)(a) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989; Sections 161, 173 and 293(4)(e) of CrPc. • Read case file and witnessed court proceedings of the writ petition (Article 226 of Indian Constitution) in public interest litigation in the case of Shiv Singh Kapurwan v. State of Uttarakhand and ors. which was based on illegal mining and the precedent of Milakh Raj v. State of Uttarakhand which dealt with Rule 13(h)(1), 13(2)(b) and 13(2)(h)(2) of Uttarakhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2005 and Section 3(d), 21(2), 21(5) and 23 (c) of Mines and Minerals (Development and Regulation) Act, 1957.
