Considerable experience before the Competition Appeal Tribunal (including sometimes as an advocate) and before the Competition Commission as well as before the traditional courts. Notable cases include:- Telefonica UK Limited & Ors v British Telecommunications plc (Supreme Court, 2013): acting for Three in the first telecoms regulatory appeal to the Supreme Court; the appeals concerns termination charge for non-geographic calls and judgment is pending;- Everything Everywhere Limited v Competition Commission & Ors [2013] EWCA Civ 154: acting for Three in successful appeals relating to mobile termination rates;- Sintesi e Ricerca SPA & Ors v Royal Dutch Shell plc & Ors: acting for Shell in the defence of UK and Dutch damages claims following on from the Commission's candlewaxes cartel decision;- Thames Water Utilities Ltd, R (on the application of) v Water Services Regulation Authority & Anor[2012] EWCA Civ 218: acting for IWNL in successfully resisting a challenge to its inset appointment for the landmark King's Cross redevelopment, the first inset appointment for a brownfield site;- Imperial Tobacco Group plc & Ors v Office of Fair Trading [2011] CAT 41: acting for Shell in its successful appeal against the OFT's infringement finding in the Tobacco case;- Acting for IWNL on a margin squeeze complaint against Anglian Water: a draft decision is due shortly from Ofwat; I also acted on margin squeeze complaints to Ofgem (resulting in binding commitments) and to Ofcom.- Acting in relation to other commercial disputes in sectors as diverse as ports, consultancy, aviation and healthcare. I started my training in litigation and was immediately seduced. I was involved heavily in Camelot's successful and high-profile judicial review against the decision to award the new National Lottery licence to a bidder backed by Richard Branson (see http://www.thelawyer.com/lawyers-in-the-lottery-fiasco/77501.article). I went from that to doing a judicial review for the Mayor of London against the Government in my second seat, Construction & Projects, and various bits of IP and IT litigation in my third-seat in IP/IT. I even managed to do some litigation in my compulsory corporate seat (in the Commercial department) but somehow did enough transactional work to tick all the necessary boxes. It was always pretty clear where I was likely to qualify. Show less
