Accomplished attorney with expertise in management of real property, with special knowledge of coal, oil & gas, and timber properties, and significant experience in commercial litigation arising from coal operations. Clients include mineral developer and land company interests, as well as individual developers and landowners. Litigated and advised on cases involving regulatory compliance with OSM and DSMRE (e.g., disputes over sediment control plans, water quality, acid mine drainage, bonding, and underground coal barriers), MSHA and other regulatory agencies, title and boundary disputes, as well as a major claim for regulatory takings against the United States. Broad experience in conflicts between mineral lessees, unmined mineral taxes, timber sales, drafting and negotiating mineral leases, deeds, contract mining agreements, easements, and related matters. Early years of law practice included diverse general practice, with emphasis on real estate title and closing (including mineral titles), tort litigation (both insurance defense and plaintiff), bank and corporate representation.
