I investigated Road Accident Fund claims and provided opinions to the Road Accident Fund on, inter alia, the merits and quantum settlement of claims. I was proactive in investigating claims with a view to creating early settlement of claims for client. This then avoids the costs and risks associated with proceeding to trial. • Oct 2004 - Apr 2013

I worked in the commercial litigation department and dealt mainly with large delictual claims for the Road Accident Fund ("RAF"). I also dealt with other delictual claims such as professional negligence claims, material damages claims, medical negligence claims, claims against a bank and stationary company for damages due to a work related injury, claims against a bus company due to injury sustained by a passenger on their bus and claims against a petroleum company for injuries caused due to the usage of some of their products. I advised clients on the law, which required legal research, and provided numerous opinions to them, which opinions were accepted by clients. I was the instructing attorney in two ground-breaking Constitutional Court cases for the RAF. These cases required extensive research so that client could be adequately advised on the stance to be taken in such matters. I appeared in the Western Cape High Court for pre-trial meetings. I drafted pleadings and ensured that my cases were well prepared. I mostly settled my cases but also proceeded to trial where this was required. I dealt with some administrative law matters eg securing a permit for a client and launching an application for review of the Department of Agriculture’s decision to refuse providing client with such permit and launching an application against the Workman's Compensation Commissioner due to their failure to process client’s claims. I was also part of a team that conducted due diligence work for the Minister of Police. This work entailed perusing extensive documents with a view to advising the Minister on how to carry out its functions in a more effective manner. I investigated claims by clients of a firm of attorneys who had settled their cases against the RAF and had allegedly overcharged them for the legal services rendered by them. I also provided opinions related hereto. I trained numerous candidate attorneys and was commended for my mentorship skills. Show less

I initially worked as a claims handler and was later promoted to the position of senior claims handler during 2002. I worked in the Arbitration Department and led a team of seven members. I assessed claims lodged with the RAF and settled same directly with attorneys who acted for the road accident fund victims. I also attended mediation and arbitration meetings at the Arbitration Forum. I also briefed RAF panel attorneys when claims became litigious and furnished instructions to them regarding such claims.
