Drugs and medical devices save and improve countless lives. And yet, for companies operating in the United States, products liability litigation cannot be avoided in its entirety. An effective defense strategy from the outset can nonetheless counter the impact of litigation, and the best strategy is one that is focused on science, in line with a company’s strategic objectives and core values, and executed by counsel who understand a client’s business and litigation goals. As a partner at Goldman Ismail, I have the privilege of representing companies in nationwide high-stakes products liability and patent litigation. Clients turn to me to help them develop case-specific and litigation-wide scientific themes, and then translating those themes into practical wins that are in line with their larger business goals, from early case resolution to trial. That experience includes developing evidence-based science themes and seeking out early opportunities to present those themes affirmatively; taking and defending key expert depositions; preparing experts for trial and building compelling trial cross examinations; and working with company scientists and other key company witnesses to tell an affirmative story from deposition to trial.
