As an Attorney in the Health Service Section I provide legal services and representation to the Health Care Personnel Registry (“HCPR”) Section within the Division of Health Service Regulation. I am responsible for the defense of patient abuse and neglect findings made by the HCPR Section, pursuant to 42 U.S.C. § 1396r(e) and N.C. Gen. Stat. §§ 131E-255 and -256. I have defended HCPR substantiations in the Office of Administrative Hearings, filed motions to dismiss, filed motions for summary judgment, and have a petition for judicial review. During the course of my job I provide legal counseling to HCPR investigators and supervisors, as well as negotiate with opposing counsel. I often work with surveyors and staff of the Mental Health and Adult Care Licensure Sections of DHHS, when the Registry cases involve a parallel licensure survey. I also work in conjunction with the Medicaid Investigations Division, and local law enforcement when the Registry cases involve an ongoing criminal investigation.
