Metro Community Living Support Services Ltd., 2017 NSCA 15 – appeal of a decision of the Nova Scotia Supreme Court granting judicial review of a labour board decision.Dalhousie University v. Nova Scotia Government and General Employees Union, 2017 NSSC 38 – responded to an application for judicial review of an arbitrator’s award.Balraj advises both employers and employees on workplace matters with a focus on terminations and constructive dismissals. The bulk of her pension and benefits practice pertains to compliance issues with legislative regimes.She also runs a social media campaign for Pink Larkin featuring the popular #WorkLawWednesday blog series.

      The Workplace Safety and Insurance Appeals Tribunal is the final level of appeals for workers’ compensation matters in Ontario. As an articling student, I assumed carriage of over 50 active files. On complicated appeals, I provided oral and written submissions as Tribunal Counsel, on issues relating to employment law and legislative interpretation. I was also assigned various research assignments involving many areas of law. I acquired the following relevant experiences while working at the WSIAT:Advocacy experience: I provided oral submissions as Tribunal counsel on an a preliminary issue that concerned the interpretation of a specific section of the Workplace Safety and Insurance Act, and written submissions on the issue of whether a worker is an independent contractor for the purpose of advancing a civil suit. Research experience: I researched issues concerning workers’ compensation, administrative, employment, insurance and constitutional law. Writing experience: the Ontario Bar Association Workers’ Compensation section published my articles on the age based limitation on loss of earnings benefits in the WSIA and on mental stress entitlement for federal workers; and I liaised with parties, representatives and Tribunal decision-makers via written correspondence, which was reproduced in WSIAT Decision No. 900/13.

      The Dalhousie Legal Aid Service is a teaching clinic, affiliated with Dalhousie University. Students are assigned their own files, along with a supervising lawyer or Community Legal Worker. The areas of law in which DLAS provides representation include: family law, youth criminal law, human rights law, adult criminal law, poverty law, and residential tenancies.I was assigned files in all areas of law that DLAS provides representation. Also, I was involved in a community development project—creating a web accessible resource cite about the Residential Tenancies Act, for landlords and tenants. I researched legal developments since the 7th edition of the textbook, focusing on any legal developments in the case law on the relationship between domestic law and international law.
