I am a passionate litigator with a track record of success in the courtroom: • successfully enforced an employee’s fiduciary obligations. The Court of Appeal upheld a finding that this departed fiduciary was prohibited from accepting business from clients even though he did not solicit them; • successfully enforced an oral agreement that there was joint ownership over an insurance producer’s book of business. When he left, he was required to pay fair market value for 50% of his book of business. This decision was upheld by the Ontario Court of Appeal; • various trials involving terminations for cause of long service employees; • represented a major mining company during an extended labour dispute. Successfully obtained numerous court orders including a limitation on the number of picketers, an order requiring picketers to remove face coverings and an order requiring the police to attend court to ensure compliance with previous court orders; • argued numerous other labour injunctions including obtaining a province wide injunction; • contempt proceedings against a union and its leadership including a motion relating to disclosure requirements; • numerous injunctions relating to the return of confidential information and restrictive covenants; • various jurisdictional and procedural motions and related appeals; • hearings and motions before the Ontario Human Rights Tribunal and the Canadian Human Rights Commission; • hearings before Adjudicators under the Canada Labour Code in the financial services and trucking industry.

Financial institutions and a wide range of public and private companies routinely retain me to litigate cases involving executive level employees, executive compensation plans, stock options, shareholder agreements and breaches by presidents and CEO's of their statutory duties. I have litigated numerous commercial disputes including partnership agreements and contracts relating to the ownership of books of business. In addition to wrongful dismissal litigation, I specialize in wrongful competition matters ranging from restrictive covenants, breach of confidence, breach of fiduciary duties, breach of good faith and conspiracy. I have been successful in numerous trials and commercial arbitrations on these issues as well as interlocutory motions. Labour injunctions are also an area of expertise.
