      Professional Real Estate Agent specializing in Section 170 Sales. The IRS Section 170 predates the IRS Section 1031 tax-deferred exchange and can be used in combination providing an excellent #1031ExitStrategy. In most cases when an investor has performed numerous 1031 exchanges, and is now looking to "cash out", this type of sale helps them minimize the depreciation recapture and capital gains taxes that could be enormous due to many deferrals of taxes throughout one or more 1031 Exchanges being performed throughout the years. However, it isn’t necessary to have deferred gains from past 1031s for the Bargain Sale to make sense. The main criteria is a property owner/entity that has a high-net worth or expects considerable future earnings or capital gains, and has a philanthropic intent. In either of these cases, the bargain sale may actually net the seller more money than by selling the real estate traditionally and paying potentially four levels of taxes: (Possible) 25% Depreciation Recapture + 20-25% capital gains + 3.8% Net Investment Income Tax (NIIT) + State Capital Gains Tax (0-13.3%). These taxes typically add up to about a third or more % of profits going to paying taxes! By using the services offered by our company and selling to a non-profit organization (our 501C-3 qualified buyers we represent) this allows the seller to potentially receive a huge tax break on the sale and a portion of the profits made on the sale fuels the non-profit’s mission.
