I am an Associate in the Competition Litigation department. The Competition Litigation department acts in the most high-profile competition cases in the UK and Europe. Our clients include FTSE 100, FTSE 250 companies and global corporations. We act on behalf of major enterprises that have been adversely affected by cartels or abuse of a dominant position. My most notable experience includes:(i) Assisting with proceedings brought on behalf of several UK retailers against MasterCard and Visa in relation to interchange fees.(ii) Acting in proceedings brought by a Swedish state-owned entity in relation to the European Commission’s high voltage power cable cartel decision.(iii) Supporting the team in initiating proceedings arising from the European Commission’s CRT/CRT Glass and LCD Cartel decisions, on behalf of a global electronics manufacturer against defendants based in jurisdictions throughout the EU, South Korea and Malaysia. (iv) Providing support in a claim brought on behalf of a Fortune 500 company to recover financial losses arising from the refrigerator compressors cartel.(v) Assisting a partner in researching and drafting advice concerning obtaining evidence from European-based entities, in a referral case involving bankruptcy proceedings before the United States Bankruptcy Court. Trainee Solicitor - Fourth Seat - Commerical Litigation
-
Mar 2019 - Sep 2019
My experience to date includes:(i) Assisting in successfully defending an application brought under sections 108 and 171 of the Insolvency Act 1986 to remove liquidators of private equity fund vehicles (the funds held majority interests in a number of well-known UK businesses, including the restaurant chain Brasserie Blanc). The funds had been put into members’ voluntary (i.e. solvent) liquidations (MVLs) in 2015 and dissolved in 2016. The companies were restored last year and our clients were appointed as liquidators following concerns by retail investors that the funds had been misused and their assets sold at an undervalue to parties related to the fund manager. The judgment gave rise to important principles concerning MVLs including: the protection of minority shareholders; ensuring a suitable liquidator holds office; and that liquidators are held to account. (ii) Assisting in successfully applying on behalf of the liquidators of the above detailed fund, under sections 108 and 171 of the Insolvency Act 1986 to secure documents and information from the fund manager and the former liquidator in order to investigate the funds’ investments. (iii) Representing a minority shareholder of a well-known online retailer in a petition under section 994 of the Companies Act 2006 as a result of unfairly prejudicial conduct brought by a majority shareholder. This is one of the first cases to be captured by the new disclosure pilot for the Business and Property Courts under Practice Direction 51U so I have been involved in complying with the new procedure and gained valuable practical insight into the provisions for extended disclosure.

(ii) Advising clients in person, by letter and by telephone on: entitlement to welfare benefits; insurance policies; continued healthcare and social care; housing; financial and debt-related issues; bankruptcy and insolvency; employment; Powers of Attorney; Deputyship and probate. (iii) I was solely responsible for running and progressing 86 cases which enabled me to enhance my case and transaction management skills due the level of autonomy and responsibility afforded to me. (iv) Drafting: challenges to insurance companies regarding refusal to pay out under a policy; complaint to the Financial Ombudsman; witness statements for the Court of Protection Deputyship applications; welfare benefits applications; submissions to a tribunal hearing an appeal regarding Industrial Injuries Disablement Benefit and submissions to the Criminal Injuries Compensation Authority. (v) Liaising and communicating with creditors (such as banks), insurance companies, local authorities, Department for Work and Pensions, Office of the Public Guardian, Court of Protection, client’s employer, medical staff and experts.
