Moses Wittemyer has been a touchstone of Colorado water law since the firm’s founding in 1973, with a practice encompassing all water-related fields of Colorado law and federal law. The MWHW attorneys specialize in complex civil litigation and transactional work related to water rights adjudication, including prosecuting water court applications for changes of senior irrigation rights, confirmation of new conditional and absolute water rights, and approval of plans for augmentation; protection of existing water rights, including prosecuting statements of opposition and working with the State and Division Engineers’ offices on record-keeping and administration; water rights title, due diligence, financing, acquisition, and conveyancing; municipal water planning; water quality control and permitting, including proceedings in front of the Colorado Water Quality Control Commission; United States Forest Service special use permitting; compliance with state and federal water quality regulations; development of water and water rights master plans; and compliance with federal environmental laws, including the Endangered Species Act, National Environmental Policy Act, Clean Water Act, and CERCLA. Moses Wittemyer’s diverse clients, a number of which have been with the firm for thirty to forty years, include municipal water and sewer providers, Colorado special districts, augmentation associations, water conservancy districts, ski resorts, energy and land development entities, ditch companies, private water companies, and individual water users. Moses Wittemyer is a participating member of the Colorado Water Congress.
