In divorce mediation, the parties discuss and negotiate their divorce – property, child custody, support – all in private, facilitated by a mediator. Divorce mediation is a process courts recognize to reduce the cost, pain and upset of a “typical” contested divorce. Judges often send couples to mediation first. Working with the mediator, the couple creates a mediated settlement agreement (MSA) tailored to their situation, not one handed down from the court. Attorneys for one or both parties are welcome as well. The parties’ counsel or attorneys use the MSA to develop their divorce decree.
